Identity and Commitments of the Parties:

Thus, these Terms of Use and Conditions of Purchase apply to the relationship between CARL JASON BENTON and MAZA RENTALS ISLAS CANARIAS SLU (hereinafter the “Company”) and you (hereinafter the “Client”), with regard to all transactions carried out on the website https://dreamapartmentscanarias.com/ (hereinafter, “Online Store”). CARL JASON BENTON, is a NATURAL PERSON, with registered office at C/ LOS SUEÑOS, 71 -PLANTA 3 – ÁTICO 38006 – (STA CRUZ DE TENERIFE), and NIE: X2082884G and MAZA RENTALS ISLAS CANARIAS SLU is a LEGAL PERSON (COMPANY) with registered office at C/ LOS SUEÑOS, 71 -PLANTA 3 – ÁTICO 38006 – (STA CRUZ DE TENERIFE), and NIF: B72807043.
Acceptance of this document implies that the user:
a. You have read, understand and comprehend what is stated herein.
b. That he is a person with sufficient capacity to enter into a contract.
c. That you assume all obligations set forth herein. The Company reserves the right to unilaterally modify these Terms, without affecting the services contracted prior to the modification. Furthermore, the user, whether individual or professional, identified on the website through their personal data provided, is involved in the contract, and they are fully responsible for their use and custody. This data will be processed in accordance with the provisions of the Company's Data Processing Policy, always respecting the applicable regulations.
By using this website, the Client consents to the processing of their data and declares that they are true and accurate. Therefore, the Client agrees to:
i. Use this website only to make legally valid inquiries or requests;
ii. Not to make any false or fraudulent requests. If there is any evidence of false or fraudulent conduct, the Company is authorized to cancel the reservation and inform the relevant authorities. Furthermore, the Company assumes no liability for any damages and/or expenses that may arise.
iii. Provide the Company with your email address, postal address, and/or other contact information in a truthful and accurate manner. Furthermore, the Client agrees that the Company may use such information to contact you, if necessary.
iv. Not misuse this website by intentionally introducing viruses, Trojan horses, worms, logic bombs, or any other technologically harmful or damaging program or material. The Client shall not attempt to gain unauthorized access to this website, the server on which it is hosted, or any server, computer, or database related to our website. Failure to comply with this clause may result in the commission of violations classified under applicable law.
The user confirms that he or she is over 18 years of age and has the legal capacity to enter into a contract. In this regard, the Company may verify, by any means it deems appropriate, compliance with the aforementioned requirement.
Purpose of the Contract
The purpose of this contract is to regulate the contractual relationship for the rental of tourist accommodation services, which arises between the Company and the Client at the time the latter accepts the commercial offer during the online contracting process.
The contractual relationship entails the provision of the selected services in the chosen modality, as offered and priced on the website, in exchange for a price determined and publicly displayed on this site.
The services offered on this website are available throughout Spain. If the Customer is located outside of this territory, the Company reserves the right to refuse and/or cancel the order.
All orders are subject to availability. In the event of service difficulties, the Company will notify you by email and refund any amounts you may have paid.
Contracting Procedure
The booking process can only be completed in Spanish and English. To place an order, the Customer must follow the online booking process and click the "REQUEST RESERVATION" button. The Customer will then receive an email acknowledging receipt of their reservation ("Booking Confirmation") along with an invoice within 24 hours of making the reservation. Customers can also check the status of their order by calling Customer Service.
In order to rent the properties offered by the provider, the Client must identify themselves through the website by completing the "RESERVATION REQUEST" form. To do so, the user must freely and voluntarily provide the personal information requested.
The user will provide identifying information, such as name, surname, email address, delivery address, telephone number, and subsequently payment information. The company undertakes to use these details diligently and only make them available to third parties, such as public authorities with jurisdiction over the matter or the financial institution. The company also undertakes to notify the provider of any loss or theft of these details, or of possible access by an unauthorized third party, so that the provider can immediately block them.
Users can find more information about the processing of personal data in the website's Legal Notice and/or in the website forms. This data processing will always be carried out in accordance with current regulations on personal data protection and, related to this, with the security measures established in accordance with our risk analysis and in a secure environment.
Once the user has been identified, please be advised that, in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting process will follow these steps:

Use of the Website, its Services and Contents
The Client agrees to use the website, its services, and content without violating current legislation, good faith, generally accepted practices, and public order. Likewise, any use of the website for illegal or harmful purposes against the Company or any third party, or that in any way may cause harm or impede the normal operation of the website, is prohibited.
With respect to the content (information, text, graphics, sound and/or image files, photographs, designs, etc.), the following are prohibited: reproduction, distribution, or modification, unless authorized by the legitimate owners or legally permitted; any violation of the rights of the Company or its legitimate owners; use for any commercial or advertising purposes other than those strictly permitted; any attempt to obtain the content of the website by any means other than those made available to users and those commonly used on the Internet, provided that they do not cause any harm to the Company's website.

Price and validity period of the offer
The prices indicated for each product include Value Added Tax (7% IGIC) or other applicable taxes or duties and will always be expressed in euros (€). These charges, unless expressly stated otherwise, do not include the costs of other additional services or ancillaries to the product or service purchased.
The price will also be shown with a breakdown of any applicable increases or discounts.
The applicable prices are valid unless the property is unavailable or there is a typographical error. They will be those published on the website and automatically applied during the final phase of the contracting process, after including shipping costs where applicable.
The client assumes that the financial valuation of some services may change in real time. This will always be communicated to users in advance.
Any payment made to the Provider will entail the provision to the Client of an invoice in the name of the registered user.

Making Reservations
Reservations will be made on the spot. Online order status check is available for registered users.
The provider assumes no liability if the reservation of the product or service cannot be completed due to the information provided by the user being false, inaccurate, or incomplete, or if the service cannot be provided for reasons beyond the provider's control.
Without prejudice to the foregoing, the provider must adopt the measures required of a diligent merchant, to the satisfaction of the customer, and therefore no liability may be attributed to the provider.
Entrances and exits
Check-in: from 4:00 p.m. to 11:00 p.m.
Check-out: By 11:00 a.m. on your last day.
The house will be available from 4:00 PM. Please be sure to let us know your approximate arrival time so we can plan your check-in and keep you informed of any delays or changes. Please provide your phone number and email address in case we need to contact you.
On the day of departure, the house will be vacated before 11:00 a.m. However, if guests wish to enter or leave the property at different times, they may do so by prior arrangement, provided the property is not occupied by another guest.
If you need a late checkout, please ask at check-in if this is possible. We will try to accommodate your request.
Please be sure to hand over ALL sets of keys before leaving.
Payment methods
You can pay for your orders using the following payment methods: 1. Credit or debit card.
Accommodation rules
Guests are responsible for keeping the house properly locked in their absence.
Guests may not engage in disruptive, unhealthy, harmful, dangerous, or illegal activities on the property.
Parties or gatherings that may cause disturbance will not be allowed.
Community noise regulations will be respected (from 10 p.m. to 10 a.m.).
Visits are not allowed without the express consent of the owner.
Bachelor/ette parties are not allowed.
The facilities will be kept in perfect working order, with each object in its original location. Any damage to the facilities must be reported to the owner.
Guests must treat the accommodation and its contents with respect and not remove anything from it. They will be responsible for any damage caused. PETS ARE NOT ALLOWED.
Please take care of the house and respect the rest of others, as well as the owners and the surrounding area in general. Dream Apartments Canarias would appreciate any suggestions you may have to make your stay more enjoyable.
Withdrawal and Cancellation Policies
Consumers may NOT cancel their contract except in cases of force majeure. COVID-related reasons will not be considered force majeure, except in cases where restrictions are imposed by public authorities at the national level. Reservations made online will NOT be refundable unless required by law.
With regard to professionals, the rules for cancellation and termination of contracts are subject to the provisions of the Commercial Code and, additionally, to the provisions of the Civil Code.

To comply with the withdrawal period, it is sufficient for you to send your communication regarding your exercise of this right before the corresponding deadline expires. You can send it by email or postal mail to the addresses indicated in the document.
Cancellation policy
The reservation deposit for 100% will be deemed to be a deposit against the amount resulting from the contracted services and is non-refundable and non-transferable. If the client wishes to cancel a reservation, a cancellation fee will be charged, equal to the total amount paid, in accordance with Decree 113/2015, of May 22, on tourist apartment establishments in the Canary Islands:
If the client changes the dates, it will be considered a new reservation and will also be subject to the cancellation policy.
Any cancellation, including force majeure, will be subject to our cancellation policy. All cancellations or changes must be made by email. Cancellations or changes made by phone will not be accepted.
Equipment
Prices include:
Water, electricity, and heating costs. Bed linen and towels are provided for each occupant. Bed linen consists of sheets, blankets, and a duvet. Bath and hand towels are provided for each occupant. Fully equipped kitchen (dishwasher, oven, ceramic hob, refrigerator, microwave, juicer, and other small appliances, as well as dishes, glasses, cutlery, pans, and saucepans). Wi-Fi is available.
Cleaning
The accommodation is cleaned before each guest's arrival. Upon departure, guests are required to leave the house in reasonable condition, with all trash disposed of properly. Failure to do so will result in a cleaning fee.
Interruption of stay
No refunds or credits will be issued if your stay is interrupted.
Applicable Law and Jurisdiction
These Terms and Conditions shall be governed by or construed in accordance with Spanish law, insofar as it is not expressly provided for herein. The Provider and the User agree to submit any dispute arising from the provision of the products or services covered by these Terms and Conditions to the Courts and Tribunals of the User's domicile.
If the user resides outside of Spain, the provider and the user expressly waive any other jurisdiction and submit to the Courts and Tribunals of Santa Cruz de Tenerife (Spain).
